1. Introduction

1.1. This Refund & Cancellation Policy governs the terms under which payments made via the Platform are processed, refunded, or cancelled.

1.2. By accessing or using EMDPay, You acknowledge and agree that all payments made through the Platform are final and binding, subject to the limited exceptions stated herein.

1.3. EMDPay acts only as a facilitator/payment technology provider between Users and Beneficiaries (such as professionals, schools, colleges, universities, landlords, housing societies, service providers, or merchants).

2. Nature of Services

2.1. EMDPay provides a technology platform enabling Users to:

  • Pay Education Fees (tutors, professionals, schools, colleges, universities, coaching centres, etc.);
  • Pay Rent, Maintenance, and Housing Society Charges;

2.2. The Platform does not determine, influence, or control the amount charged, payment schedule, or refund policy of the Beneficiaries.

3. General Refund & Cancellation Principles

3.1. All payments once made via EMDPay are deemed final and irrevocable, except in the following cases:

  • Duplicate transaction caused by system error;
  • Wrong deduction from User account without transaction confirmation;
  • Technical failure resulting in unsuccessful payment but debit from User account.

3.2. Refunds in such cases will only be processed after receiving confirmation from the concerned bank, NPCI, payment gateway, or beneficiary institution.

3.3. Refunds, if approved, will be credited to the original source account within 7–21 working days, subject to bank/payment gateway timelines.

4. Education Fee Payments

4.1. No refunds shall be entertained for education fee payments once successfully credited to the third party.

4.2. Any disputes regarding overpayment, withdrawal, admission cancellation, or fee adjustment must be resolved directly between the User and the Third Party.

4.3. EMDPay has no role in negotiating or facilitating refunds of educational fees.

5. Rent & Maintenance Payments

5.1. Rent, lease deposits, and housing maintenance charges once paid are non-refundable through the Platform.

5.2. Disputes related to tenancy, landlord-tenant disagreements, or refund of security deposits must be resolved mutually between the parties.

5.3. EMDPay is not responsible for refund or cancellation requests arising from tenancy or contractual disputes.

6. UPI & Bank Transfer Transactions

6.1. All UPI and IMPS/NEFT/RTGS transactions are instant and irreversible once successfully processed.

6.2. In case of a wrong transfer (e.g., incorrect beneficiary details entered by the User), EMDPay shall not be liable to recover or refund the amount.

6.3. Recovery of funds (if possible) must be pursued by the User directly with the beneficiary bank as per NPCI/ RBI guidelines.

7. Technical Errors & Failed Transactions

7.1. If a transaction fails due to technical error but the User’s account is debited, the debited amount will be automatically refunded to the original payment source within 7-21 working days.

7.2. If the refund is not credited within the stipulated time, the User may raise a complaint by writing to support@emdpay.in, along with transaction details.

8. Chargebacks & Disputes

8.1. Users are not entitled to raise chargebacks for transactions that are successful and duly authorized.

8.2. In case of fraudulent or unauthorized transactions, Users must immediately notify their bank/payment provider.

8.3. EMDPay may assist with necessary documentation but has no liability for fraudulent activity arising out of User negligence (e.g., OTP sharing, weak passwords, lost devices).

9. Cancellation Policy

9.1. Once a payment is authorized and processed, it cannot be cancelled by the User through the Platform.

9.2. Scheduled payments, if offered in future, may be cancelled before the scheduled execution time, subject to system feasibility.

9.3. Any cancellations post-processing must be dealt with directly by the User and the Beneficiary.

10. Limitation of Liability

10.1. EMDPay is a facilitator only and does not guarantee refund or recovery of funds once transferred to a Beneficiary.

10.2. The Company is not liable for:

  • Wrong beneficiary details entered by the User;
  • Beneficiary refusal to refund;
  • Delay by banks, NPCI, or payment gateways;
  • Losses arising from disputes between Users and Beneficiaries (schools, landlords, service providers).

10.3. In all cases, EMDPay’s liability shall be limited to the transaction fee charged (if any) for the disputed payment.

11. Governing Law & Jurisdiction

This Refund & Cancellation Policy shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in New Delhi.
